Welcome to ImageDescriberAI. These Terms of Service ("Terms") govern your access to and use of our website, services, and applications (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

1. Account Registration

To use our Service, you must:

• Be at least 13 years of age
• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Accept responsibility for all activities that occur under your account

You may not create an account using a false identity or impersonate another person or entity.

2. Credits and Payments

Credit System

• 1 credit = 1 image description generation
• Credits are non-transferable and cannot be exchanged for cash
• New users receive 1 free credit upon registration
• Credits do not expire unless your account is terminated

Purchases

• All purchases are processed through our secure payment processor
• Prices are listed in USD and may be subject to change
• One-time purchases and subscriptions are available
• You can purchase multiple credit packages simultaneously

Subscriptions

• Subscriptions renew automatically on a monthly basis
• You can hold multiple active subscriptions for different packages
• You cannot have duplicate subscriptions for the same package
• You can cancel your subscription at any time
• Cancellation takes effect at the end of the current billing period
• No refunds for partial months

Refunds

Refund requests are handled on a case-by-case basis. If a refund is approved, we will deduct the corresponding credits from your account. If you have already used the credits, you may end up with a negative balance, which must be resolved before additional credits can be used.

3. Acceptable Use Policy

You agree not to use the Service to:

• Upload illegal, harmful, threatening, abusive, or offensive content
• Upload images containing child exploitation material or non-consensual intimate images
• Violate intellectual property rights of others
• Engage in automated scraping or data harvesting without permission
• Attempt to bypass credit systems or security measures
• Interfere with or disrupt the Service or servers
• Impersonate any person or entity
• Upload malware, viruses, or other malicious code

4. Image Upload Guidelines

• Maximum file size: 5MB per image
• Supported formats: JPG, PNG, WEBP
• Images are temporarily stored for processing and automatically deleted afterward
• You retain all rights to your uploaded images
• By uploading, you grant us a limited license to process images for description generation

5. API Usage

If you use our API:

• You must authenticate using your API key
• Keep your API key secure and do not share it publicly
• API credits are deducted from your account balance
• Rate limits may apply to prevent abuse
• We reserve the right to revoke API access for violations

6. Intellectual Property Rights

Our Content

The Service, including its design, code, features, and branding, is owned by ImageDescriberAI and protected by copyright, trademark, and other intellectual property laws.

Your Content

You retain all rights to images you upload. Generated descriptions are provided to you for your use, and you may use them for any lawful purpose.

AI-Generated Content

Descriptions generated by our AI are provided "as-is." While we strive for accuracy, we do not guarantee that AI-generated descriptions are error-free or suitable for all purposes. You are responsible for reviewing and verifying the content before use.

7. Service Availability and Modifications

We reserve the right to:

• Modify, suspend, or discontinue the Service at any time
• Update pricing and credit packages with notice
• Perform maintenance and updates
• Implement new features or remove existing ones

We will make reasonable efforts to provide notice of significant changes, but we are not obligated to maintain backward compatibility or preserve features indefinitely.

8. Account Termination

We may suspend or terminate your account if you:

• Violate these Terms of Service
• Engage in fraudulent activity
• Abuse the Service or other users
• Fail to pay for services

You may delete your account at any time through your account settings. Upon termination, your unused credits will be forfeited, and you will lose access to the Service.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Accuracy, reliability, or completeness of AI-generated descriptions
• Uninterrupted or error-free operation
• Fitness for a particular purpose
• Security of data transmission

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IMAGEDESCRIBERAI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your use or inability to use the Service
• Unauthorized access to your account
• Errors or inaccuracies in AI-generated content
• Any conduct or content of third parties

11. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which ImageDescriberAI operates, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration or in the courts of the applicable jurisdiction.

We reserve the right to modify these Terms at any time. We will notify users of material changes by email or through a notice on the Service. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
